Enas Taleb, an actress from Iraq, has filed a lawsuit against The Economist for using a photograph of her in an article without her permission. According to the fundamental principles of the Copyright Rules for photographs, the rights to the image belong to the individual who took the photograph.

In this particular instance, Karar Essa was the one who took the photograph of Taleb, which means that he owns the copyright.

However, the Turkish News Agency Anadolu is also listed on the photo’s credit tag on Getty Images; this suggests they may share ownership of the photo’s rights.

According to BBC, Enas Taleb plans to file a claim seeking “compensation for the emotional, mental, and social damage this incident has caused” to her. Even though she might not have a solid case to get paid for using the picture, Taleb still has the option to sue for defamation of character. Taleb has a chance of winning the case if the actress can provide evidence that the picture damaged her reputation.
